1.Scope and Sole Warrantor
GlasFens, LLC ("GF") warrants to the original Buyer that the products it supplies will be free from defects in materials and manufacturing workmanship, for the periods and subject to the conditions, exclusions, remedies, and limitations set out below. GF is the sole warrantor under this Limited Warranty. Buyer's and any transferee's recourse for a product defect is solely to GF. This Limited Warranty covers the product as supplied by GF; it does not cover installation, which is performed by the Buyer or others.
THIS LIMITED WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY GIVEN BY GF AND REPLACES ALL OTHER WARRANTIES. TO THE FULLEST EXTENT PERMITTED BY LAW, ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE APPLICABLE WARRANTY PERIOD STATED BELOW AND ARE OTHERWISE DISCLAIMED.
2.Warranty Periods
Each period below runs from the earlier of (a) the date of shipment of the product or (b) the date of substantial completion of installation, and runs concurrently with, not consecutively to, the other periods. Coverage requires registration and full payment as described in Sections 5 and 6.

For a hybrid insulating glass unit, the 25-year period applies only to the vacuum component and its failure modes listed above; all other failure modes of the hybrid unit, including its conventional sealed airspace and edge seal, are covered for the 10-year period. Where a component is manufactured to a HEIT (high velocity hurricane zone or hot climate) or coastal specification, the periods above apply only if the product is installed and maintained in accordance with the corresponding installation and maintenance requirements identified on the Quote or shop drawings.
Pro-rata adjustment (vacuum glazing): For any claim under the 25-year vacuum glazing coverage arising after the fifteenth (15th) year, GF's obligation is pro-rated: GF will supply a replacement unit at a share of its then-current price equal to the number of full years remaining in the period divided by the total period. This preserves long-term coverage while tapering exposure over time.
3.Sole and Exclusive Remedy
For any valid claim under this Limited Warranty, Buyer's sole and exclusive remedy — and GF's entire obligation — is, at GF's sole election, to (a) repair the affected product, (b) supply a replacement product or component, or (c) refund the portion of the purchase price allocable to the affected product. This is a product-supply remedy. GF may satisfy it by repairing the product, by supplying a replacement from inventory, by shipping a replacement, or by making a replacement available at the original point of shipment, as GF elects. Replacement product may be of current manufacture and may differ in minor respects — including color, finish, and profile — from the original where the original is no longer produced. Repair or replacement does not restart or extend any warranty period; the replacement is warranted only for the remainder of the original period.
4.Labor, Access, Freight, and Installation Not Covered
THIS LIMITED WARRANTY COVERS THE PRODUCT ONLY. IT DOES NOT COVER, AND GF IS NOT RESPONSIBLE FOR, ANY OF THE FOLLOWING: REMOVAL OR REINSTALLATION OF PRODUCT; LABOR OF ANY KIND; SCAFFOLDING, SWING STAGES, MAN LIFTS, CRANES, HOISTS, OR OTHER ACCESS OR RIGGING EQUIPMENT; TRAFFIC CONTROL OR SITE PROTECTION; FREIGHT OR IMPORT CHARGES ON REPLACEMENT PRODUCT BEYOND THE ORIGINAL POINT OF SHIPMENT; OR ANY OTHER COST OF ACCESSING, DIAGNOSING, OR MAKING GOOD AROUND THE PRODUCT.
5.Registration and Conditions of Coverage
Coverage under this Limited Warranty is conditioned on all of the following. If any condition is not met, the affected claim is not covered.
- Registration. The project has been registered with GF, including submission of interior and exterior photographs of the completed installation through the GF warranty registration process.
- Payment. All sums due to GF for the product have been paid in full in strict accordance with the Quote and the General Terms and Conditions. Non-payment, chargeback, or unauthorized offset voids applicable warranties.
- Installation. The product was installed in accordance with GF shop drawings, published installation instructions, and good industry practice, using compatible sealants, flashings, and fasteners.
- Maintenance. The product has been maintained and cleaned in accordance with the GF Care and Maintenance Guidelines, including any coastal or HVHZ maintenance required for those specifications.
- Operation within limits. Operable products have been operated within their published limits, including the wind, snow, ice, and debris limitations stated in the General Terms and Conditions and on the product literature.
6.How to Make a Claim
Buyer or a transferee must notify GF of a warranty claim in writing within sixty (60) days after the defect is discovered or reasonably should have been discovered. This latent-defect notice period is separate from, and additional to, the five (5) business day receiving-inspection period for visible damage, transit damage, shortage, and nonconformity set out in the General Terms and Conditions. The written notice must include the project registration reference, a description of the claimed defect, and clear photographs. GF must be given a reasonable opportunity to inspect the product before any corrective action is taken. Buyer shall not return any product without GF's prior written authorization, and GF will furnish instructions for disposition of product it accepts as defective.
7.Exclusions
This Limited Warranty does not apply to, and GF is not liable for, any of the following:
- Installation performed by the Buyer or others, and any defect, failure, water infiltration, or damage caused in whole or in part by installation, by incompatible or improperly applied sealants, flashings, or fasteners, or by failure to follow GF shop drawings and instructions.
- Glass breakage from any cause after risk has passed to Buyer, including impact and thermal stress, and thermal stress arising from applied films, tints, or interior treatments not supplied by GF.
- Building movement, settlement, deflection, racking, or structural failure, and any damage to or caused by adjoining construction.
- Abuse, misuse, accident, vandalism, neglect, operation outside published limits, or alteration, repair, or refinishing of the product by anyone other than GF.
- Failure to maintain or clean the product per the GF Care and Maintenance Guidelines, and use of improper cleaning methods or chemicals.
- Condensation, and normal weathering, color variation, and tint or coating variation within accepted industry standards.
- Corrosion or finish degradation in coastal, marine, or corrosive environments where the specified coastal or HVHZ product, installation, and maintenance were not used.
- Components, hardware, finishes, or glass supplied or specified by Buyer or others, which carry no GF warranty and are the Buyer's responsibility as to compatibility and performance.
- Acts of God, fire, flood, storm exceeding the product's rated design pressure, war, civil unrest, and other events beyond GF's reasonable control.
8.Warranty Terms Specific to This Sale
Product Warranty Only
This Limited Product Warranty covers products supplied by GF. It does not cover installation or any work performed by the Buyer, an installer, contractor, glazing contractor, dealer, reseller, or other party. GF does not employ, retain, supervise, direct, control, or warrant the installer. Product defects remain subject to this Limited Product Warranty. Installation defects and damage caused by installation remain the responsibility of the party performing or contracting for the installation.
Labor, Access, Removal, and Reinstallation: The Buyer or current property owner is responsible for arranging and paying for removal, reinstallation, access equipment, scaffolding, lifts, cranes, hoists, field labor, site protection, finish repairs, and other work required to access or replace a warranted product. GF may provide reasonable product information to the responsible installer but does not contract for, coordinate, or warrant that work.
Warranty Holder and Transfer
This Limited Product Warranty is initially issued in connection with the Trade Buyer's purchase. Upon full payment and registration of the completed project, the warranty may be transferred to the identified property owner or end user. The Buyer must register the project with GF, including the project address, the property owner's identity and contact information, and interior and exterior photographs of the completed installation. Transfer of the GF product warranty does not transfer or replace any installation, workmanship, service, or contractual warranty owed by the Trade Buyer to its customer. A transferee receives only the unexpired balance of the applicable warranty periods; transfer does not restart or extend any period.
Claims and Communications
Warranty claims may be submitted by the Buyer or, after transfer, by the registered property owner or end user directly. The Buyer shall provide GF with current project and owner information and authorizes GF to communicate with the property owner or end user concerning warranty claims, safety matters, and service. Components, hardware, finishes, and glass supplied or specified by the Buyer outside GF's standard offering are excluded from coverage and are the Buyer's responsibility.
9.Limitation of Liability
THE REMEDY IN SECTION 3 IS BUYER'S SOLE AND EXCLUSIVE REMEDY. IN NO EVENT WILL GF BE LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, HOWSOEVER CAUSED AND WHETHER OR NOT FORESEEABLE, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST RENTS, LOSS OF USE, DELAY OR LIQUIDATED DAMAGES, DAMAGE TO THE BUILDING OR ITS CONTENTS, MOLD, OR THE COST OF LABOR, ACCESS, OR MATERIALS EXPENDED BY OTHERS. GF'S TOTAL LIABILITY UNDER OR RELATING TO THIS LIMITED WARRANTY WILL NOT EXCEED THE PURCHASE PRICE PAID TO GF FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages or limitations on how long an implied warranty lasts, so some of the above limitations may not apply. This Limited Warranty gives specific legal rights, and there may be other rights that vary by jurisdiction.
10.Time to Bring Suit; Accrual
This Limited Warranty extends to future performance of the product. A cause of action for breach of this Limited Warranty accrues when GF fails to remedy a defect within a reasonable time after receiving a proper and timely written claim under Section 6. Any suit or action for breach of this Limited Warranty must be commenced within one (1) year after the cause of action so accrues. This provision governs claims under this Limited Warranty; the separate one-year limitation in the General Terms and Conditions, which accrues at delivery, governs claims for transit damage, shortage, nonconformity, and other non-warranty matters.
11.Governing Law and Venue
This Limited Warranty is governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules. The Middlesex County Superior Court and the United States District Court for the District of Massachusetts are the sole and exclusive venues for any dispute under this Limited Warranty. This Limited Warranty is incorporated into and forms part of the parties' contract together with the GF General Terms and Conditions.
